Chapter 7: Liquidation

Chapter 7 is the most common Chapter of bankruptcy filed by consumers.  Chapter 7 is quick, instant, and gets rid of LITERALLY almost all types of debt.  The best benefit of Chapter 7 is its offering of VAST protections, such as:

  • Stop repossessions

  • Save your car

  • Stop evictions

  • Get rid of medical bills

  • Get rid of credit card debt

  • Keep your tax refund

  • Keep your retirement accounts

  • Avoid bank levies

  • Protect your assets

  • Protect your cash

If you are in a bad situation, and you need to stop an eviction, stop your car from being repossessed, or stop creditors from coming after you, a Chapter 7 may work.  It will stop creditors in their tracks, IMMEDIATELY.

Chapter 13: Reorganization

Chapter 13 has many of the same benefits as a Chapter 7, but in addition, it lets you KEEP YOUR HOUSE, and saves it from foreclosure.

Chapter 13 is not for the faint of heart.   It requires patience, organization, and commitment.  If your assets cannot be protected in a Chapter 7, such as your house, then a Chapter 13 may be a better option.  You can still eliminate your unsecured debt, like your credit cards and medical bills.  We will work out a repayment plan for either 3 or 5 years, discharging all unpaid debt at the end.
